By accessing or using Claakit ("the Service"), operated by Alwise Studio, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Your continued use of the Service constitutes acceptance of these terms and any updates we may make.

2. Use of Service

Claakit provides an AI-powered platform for creating and sharing AI-generated images and videos. You must use the Service in compliance with applicable laws and these terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. User Content

You retain ownership of content you create or upload. By using the Service, you grant Claakit a non-exclusive, royalty-free, worldwide license to process, store, display, and use your content as necessary to provide, operate, and improve the Service. This license terminates when you delete your content or account, except where we are required to retain copies for legal or operational purposes.

4. AI-Generated Content

Content generated by our AI tools is subject to our usage policies. You are responsible for ensuring that your use of AI-generated content complies with these terms and applicable law. We do not guarantee the accuracy, quality, or suitability of AI-generated content for any particular purpose.

5. Payments

Purchases of credits and subscriptions are non-refundable except where required by law. Generation time and credits do not expire. Prices and plans may change; we will notify you of material changes before they take effect. You are responsible for any applicable taxes.

6. Prohibited Conduct

You may not use the Service to create, share, or promote content that is illegal, harmful, infringing, defamatory, or violates the rights of others. Prohibited uses include harassment, impersonation, spam, circumventing security measures, reverse engineering, or using the Service for any purpose that violates these terms or applicable law.

7. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may delete your account at any time. See our Account Deletion page for instructions.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by law, Claakit and Alwise Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Accra, Ghana.
